Renowned Civil Rights Attorney V. James DeSimone Joins Appalling Sexual Harassment Case Against Loot Crate

LOS ANGELES, CALIF., USA, April 24, 2018 / -- Veteran civil rights attorney V. James DeSimone has joined as trial counsel in a major lawsuit accusing an executive at comics-and-gamers collectibles service Loot Crate of particularly egregious sexual harassment.

“It’s an abuse of power situation,” said DeSimone, whose practice focuses on employment discrimination and harassment. “The same supervisor who sexually harassed our client was allowed to fire her right after she complained.”

The harassment started as soon as the woman was hired to join Loot Crate’s accounting department in February 2017, according to the lawsuit. Just as the #MeToo movement was bringing national attention to endemic workplace sexual harassment and assault, the female accountant’s Loot Cart supervisor – the assistant corporate controller subjected her to a constant barrage of sexual emails, lewd comments, and suggestive and intimidating actions, the lawsuit says.

“(He) touched the plaintiff’s behind, motioned like he was taking up-skirt pictures, motioned in the air as if he was performing oral sex on a woman and accosted the plaintiff for sex, paid if need be,” according to the lawsuit.

“Those boots make your ass wiggle!!!” the manager texted, according to the lawsuit. On another day, the lawsuit says, he texted: “I have just decided I’m going to lust after you for a while! With pleasure! I may be twitching a little! Ok ok I admit it! I stared! I need to be blunt! I need to go find a you to f***!!! I may just have to find one I have to pay for! Know anyone?? Lol”

The woman complained to Loot Crate’s human resources department, which never investigated and told her to bring the matter to the controller, who told her to solve the problem herself, according to the lawsuit.

She finally confronted her boss, asking him to end his harassment, and was unlawfully fired on his recommendation days later, the lawsuit says.

The wrongful termination lawsuit seeks $10 million in damages. It was filed in Los Angeles Superior Court on Jan. 5 under the name of Jane Doe, to maintain the woman’s privacy, by Jonathan LaCour of Employees First Labor Law, of Los Angeles, Orange and Riverside counties, who will co-counsel the case with V. James DeSimone Law.

Los Angeles-based Loot Crate in 2016 was considered one of the nation’s fastest-growing companies by Inc. and today is in the midst of seeking investors. Three members of the company’s board recently resigned. Loot Crate’s partners include Nickelodeon, Marvel, D.C. Comics, Nintendo, Sanrio and J.K. Rowling’s Wizarding World.
