Attorney on E-Scooter Injury Claims: “The Wild Wild West Until We Get This Sorted Out”

BLOOMINGTON, INDIANA, US, December 11, 2018 /EINPresswire.com/ -- Betsy Greene, an injury attorney in Bloomington, Indiana, recently gave several important tips about e-scooters during a video interview that has gone viral. The interview took place on the AskTheLawyers.com™ Facebook page.


Greene explained that because these are such new forms of transportation, a lot is still unclear about who is liable, and for what. Lime and Bird are the major scooter companies operating in most cities, and they have taken measures to protect themselves from liability.


“They do put warnings on there,” she said, referring to the companies’ apps. “They do have disclaimers. Whether those are going to be legally sufficient probably depends from state to state.”


She cautions that riders do share some of the liability. If you are not in a physical or mental capacity to ride a scooter, she says you shouldn’t take your chances.


E-Scooter Accidents - Who is Liable?


Liability largely depends on the accident, and who broke the traffic laws. This could include the scooter user, a car driver, or the manufacturer if there is a product defect.


However, one major roadblock prevents most scooter riders from suing companies like Lime and Bird - an arbitration clause.


“All across America when we engage in consumer transactions, we as citizens are waiving our rights to jury and don't even realize it, because the apps contain an agreement to arbitrate, and an arbitration is never going to favor the little person, the individual person, ever,” she said. “You waive your right to a jury trial in your own jurisdiction. This is a real problem.”


She says that due to the uncertainty of the industry, victims of scooter accidents need to contact a lawyer immediately.


“Get an attorney involved early because this is a little bit of the wild wild west until we get it sorted out,” she said. “And you need a fighter on your side to help you sort it out. “
